National Summary

The Omnibus Transportation Employee Testing Act of 1991 requires that all employees in safety-sensitive transportation occupations, such as drivers of commercial motor vehicles, be tested for drugs and alcohol. The rules and procedures for conducting these tests are published by the Department of Transportation (DOT). The federal regulations on testing for alcohol and controlled substances are in 49 CFR 40 and 49 CFR 382. The tests consist of urine testing for controlled substances and breath testing for alcohol.
