National Summary

The Drug-Free Workplace Act (41 USC 701 et seq.) requires specific steps from federal grantees of any amount and recipients of federal contracts of $100,000 or more. Employers not covered under the Act (or a state law mandating such a program) have more freedom when creating drug-free workplace programs. There is no one "right" way to implement a drug-free workplace. An employer's program should be designed to meet the particular needs of its workplace.
